Service Agreement – HC Digital

Thank you for considering HC Digital for your photography and videography needs. To ensure a clear understanding of our booking process, policies, and expectations, please review the following terms and conditions:

1. Booking Process and Payment:
a. By making a booking with HC Digital Photography, you agree to pay a 50% deposit to secure your booking.
b. The remaining balance will be due post-event.
c. The booking fee is non-refundable but can be transferred to a later date upon agreement with HC Digital Photography.
d. Any out-of-pocket expenses incurred during the event will be added to the total cost and communicated to the client.

2. Refunds and Cancellations:
a. Refunds are only applicable in the unlikely event that you are unable to proceed with the event or reschedule for a later date due to exceptional circumstances.
b. To request a refund, you must provide evidence of the circumstances via email to [bookings@hcdigitalperth.com.au](mailto:bookings@hcdigitalperth.com.au) and call us at +61450054318 to explain your situation.
c. HC Digital reserves the right to review refund requests on a case-by-case basis.

3. Venue and Property Damage:
a. HC Digital is not liable for any damages to the event venue or property during the photography session.
b. The client assumes responsibility for ensuring the safety and protection of the event venue and property during the session.

4. Copyright and Image Usage:
a. All images and videos captured by HC Digital are protected by copyright laws.
b. HC Digital retains full ownership and copyright of all images and videos taken during the booking.
c. Clients are granted permission to use the images for social media. Any advertising material including websites, print and large-scale commercial purposes such as billboards, large-scale campaigns, merchandise, or any other high-revenue-generating activities is forbidden unless explicitly agreed upon with HC Digital Photography.
d. The Client is not authorized to:
– Sell, assign, lease, sublicense, or transfer the Photographs or any rights granted under this Agreement to any third party without the prior written consent of the Photographer.
– Edit or alter the Photographs in a way that materially distorts their content or misrepresents the Photographer’s work.
e. The Client agrees to credit the Photographer as the author of the Photographs in all uses of the Photographs. Wherever possible, the credit line shall include a link to the Photographer’s website or social media, for example, “Photo by HC Digital Perth” with links such as Instagram: @hcdigital.perth or website: [www.hcdigitalperth.com.au](https://www.hcdigitalperth.com.au).

5. Image Processing and Delivery:
a. HC Digital Photography will require a minimum of 2 weeks and a maximum of 3 weeks for image and video processing after the booking.
b. We strive to deliver high-quality edited images and videos within the specified timeframe, ensuring attention to detail and artistic presentation.

6. Travel:
a. Bookings located more than 25km outside of the CBD may be subject to additional charges.
b. HC Digital Photography will communicate any applicable travel charges to the client prior to confirming the booking.

7. Refunds for Technical Difficulties:
a. In the unlikely event of technical difficulties that prevent HC Digital Photography from delivering the agreed-upon services, a refund may be provided.
b. HC Digital Photography will make reasonable efforts to rectify any technical difficulties before considering a refund.

8. Agreement to Terms:
By booking with HC Digital Photography, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this booking policy.
